The European Directive on Markets in Financial Instruments (MiFID II) sets forth far-reaching requirements for investment counselors in Europe. However, private law investment counseling liability is still regulated by national legal regimes. This study examines the liability of investment counselors under German, English, and Italian law. It considers the private law implications of MiFID II and weighs further legal harmonization.
