Volume 2 of this handbook comments on the protection of cultural goods from the civil law perspective and examines the ways and means of restitution for cultural goods obtained illegally. The legal acts of acquisition and adverse possession of illicitly transferred artwork as well as the statutory period of limitation and the forfeiture of cultural restitution claims are commented upon from a comparative law point of view. The reader is provided with comprehensive checklists to determine the legally required standards for the acquisition of artwork and cultural goods. A comprehensive presentation of possible sources of documentation for provenance research provides assistance to those in daily practice. In conclusion, the reader is informed in-depth of the legal risks involved in careless behavior on the (inter) national art market. Possible restitution obligations, economic losses and claims for damage in regard to the trade of tainted objects as well as criminal sanctions, penalty charges and internal association sanctions are explained in detail.
