This book deals with judiciary power in the German legal and political system. Klaus Joachim Grigoleit rejects exaggerated ideas of the Federal Constitutional Court as a predominant participant in governmental leadership not only from a legal but also from an historical perspective. Judicial restraint is guaranteed by the principles of legitimation as well as by appointments to the bench which are made according to rules which prevent the formation of a court which could function as a kind of counter-government and participate in decisions regarding the future of the country.

The court's decisions covering the "German question6quot; (political situation in the past, separation of East and West Germany, reunification) show that the significance of the "countermajoritarian difficulty" has been overestimated, although there is no political question doctrine in German constitutional law.
