Kay Waechter shows which principles have to apply so that the state can perform its functions in spite of this. He describes the essential features of a general section of infrastructure law, establishes the material principles which influence infrastructure law and shows which measures have to be taken as a result of this. At the same time, he defines the significance of infrastructure law for a uniform understanding of administrative law. As references for establishing the principles of infrastructure law, the author uses public property law and service public. He describes the principles of infrastructure law in a systematic context, showing that the present law has left some important questions unanswered.

Das Infrastrukturrecht befasst sich mit der Gewährleistung grundlegender Einrichtungen der Daseinsvorsorge. Im Laufe der letzten Jahre sind viele dieser Einrichtungen privatisiert worden. Kay Waechter veranschaulicht, welche Grundsätze gelten müssen, damit der Staat seine Aufgaben dennoch erfüllen kann.
