In this work, the author explores the issue of penalty increases or sentence mitigations for various criminal offences in Germany, focusing in particular on the method of the standard example, which - due to its flexibility - is increasingly being employed to determine and fix penalties. Although this method has spread considerably, it has been subjected to a great deal of criticism in legal literature because of its vagueness and the resulting lack of legal security. Jörg Eisele provides the first comprehensive scholarly analysis of this method. He outlines solutions to the various problems involved in theory and in practice and discusses the constitutional aspects and broader implications for European criminal law.
