The electoral system is of decisive importance in a democracy because questions of electoral law are questions of power. Jan-Marcel Drossel examines the leeway that Germany's Basic Law affords the legislature in designing the electoral system for the Bundestag elections. Showing that electoral systems cannot always be sharply categorized, he argues for a far-reaching concept of electoral equality that, in contrast to previous case law, transcends all systems.
