Multiple party finance scandals, including those surrounding the former German Chancellor Helmut Kohl, the Christian Democratic Party (CDU) of the state of Hesse as well as the Social Democratic Party (SPD) of the city of Cologne, have made the Political Parties Act the center of political and legal discussion. As a result, the criminal justice system was faced with the necessity of dealing with this problem in certain criminal cases and the legislature too reacted by passing new legislation concerning Germany's Political Parties Act in 2002. Die Parteienfinanzierungsskandale der letzten Jahre, von Kohl über Hessen-CDU und Kölner SPD bis hin zum Fall Möllemann, haben das Parteiengesetz in den Focus von Politik, Rechtspraxis und Rechtswissenschaft gerückt. Insbesondere die Strafjustiz mußte und muß in mehreren Verfahren klären, ob sich die Beteiligten strafbar gemacht haben. Der Gesetzgeber hat auf die Affären 2002 mit der Novellierung des Parteiengesetzes reagiert. Unter anderem hat er zum ersten Mal in der Geschichte des Parteiengesetzes Strafvorschriften aufgenommen. Frank Saliger untersucht erstmals monographisch die Frage, ob und inwieweit sich Personen, die gegen das Parteiengesetz verstoßen, strafbar machen können. Prüfungsgegenstand ist das alte und das neue Recht. Im Zentrum stehen die Strafvorschrift der Untreue (§ 266 StGB) und die neuen Strafvorschriften des Parteiengesetzes (§ 31 d). Zugleich wird zu zahlreichen öffentlich-rechtlichen Streitfragen Stellung bezogen. Der Verfasser verficht die These, daß zum Schutz der Parteien und zur Wahrung der Normen des Parteiengesetzes auch das Strafrecht einen Beitrag leisten kann.
