The authors of the articles in this volume deal with the legal issues resulting from the state's participation in business life which in France are discussed using the term marchés publiques and in Germany using the term "public contracts."

The state's participation in business life has resulted in a great deal of legal issues which in France are discussed using the term marchés publiques and in Germany using the term "public contracts." Due to the guidelines given in European law, there has been a change from a simple procedure of awarding contracts to a procedure which is influenced by the law on competition. This collection of articles contains the papers presented at the 12th German-French Jurists' Meeting in 2007, at which the problems in connection with this subject were discussed from the perspective of civil law, public law, competition law and criminal law.
