A theft can only be committed by someone who steals something which is in the possession of another person in accordance with civil law. Based on this fact, Anna-Maria Brutscher discusses the extent to which and according to which standards foreign civil law should and should be allowed to find its way into the evaluation by criminal law of a case in which the facts have an international element.
