This crisis is caused by the standard concept of the objective affairs of another which evens out the existing inconsistencies and enforces inappropriate values in the law of negotiorum gestio. Three legal institutions are concealed behind the standard heading negotiorum gestio (benevolent intervention in another's affairs), all of which could scarcely differ more in the nature of their interests. In spite of tentative approaches of the glossators this structural trichotomy of the law of negotiorum gestio has not been seen up to now. Instead of this, there was an obsession with the standard concept of the objective affairs of another which evens out the existing inconsistencies and enforces inappropriate values of the law of unjustified enrichment in the law of negotiorum gestio . This has resulted in the current crisis in negotiorum gestio, in which the Anglo-American model is increasingly being used to demand the abolition of the negotiorum gestio as an independent institution. Hinter der Überschrift negotiorum gestio (Geschäftsführung ohne Auftrag) verbergen sich drei Rechtsinstitute, die in ihrer Interessenstruktur unterschiedlicher kaum gedacht werden können. Diese strukturelle Dreiteilung des Geschäftsführungsrechts wurde trotz erster Ansätze bei den Glossatoren bisher nicht gesehen. Stattdessen erfolgte im Anschluss an Cujas und Donellus eine Fixierung auf den Begriff des fremden Geschäfts, der die bestehenden Interessenunterschiede nivelliert und unpassende Wertungen in das Recht der GoA implementiert. Folge ist die gegenwärtige Krise des Gestionsrechts, in der zunehmend die Aufgabe der negotiorum gestio als selbständiges Institut gefordert wird. Aus einer subordinationsrechtlichen Betrachtungsweise heraus entwirft Andreas Bergmann ein neues Bild der GoA als selbständiges Rechtsinstitut der nicht durch Gesetz oder Vertrag geregelten, tatsächlich übernommenen Interessenwahrnehmung für einen anderen.
