Islamic law is rarely considered particularly systematic or coherent. However, an analysis of the development of the Islamic notions of equity ( istisn , sometimes also translated as "juristic preference" or "favourable construction") between the second/eighth and the eighth/fourteenth centuries proves this presumption wrong. During this time period, istisn was a driving force with regard to the systematisation of Islamic law. This serves as an example of the profound structural transformation Islamic legal theory underwent in its post-formative stage. Simultaneously, a teleological notion of natural law in an Aristotelian tradition comes to the fore. It is based on the presumption that law is coherent - that equal things are treated equally while unequal things are treated unequally.

Das islamische Recht gilt vielen als Beispiel heilloser Inkohärenz - Max Weber hielt es schlicht für irrational. Die Systematik und Kohärenz des islamischen Rechts erschließt sich nur, wenn man die spezifisch methodischen Probleme versteht, die mit seiner ihm eigenen Offenbarungsbasiertheit und -gebundenheit einhergehen. Einen solchen Versuch unternimmt Rike Sinder, indem sie die Entwicklung islamischrechtlicher Billigkeit ( istisn , dt. etwa "Für-gut-Halten") zwischen dem 2./8. sowie dem 8./14. Jahrhundert untersucht. Sie zeigt auf, dass das Rechtsinstitut des istisn in dieser Zeit als Motor der Systematisierung islamischen Rechtsdenkens fungierte. An ihm lässt sich ein beispielloser Strukturwandel nachvollziehen, der als Systematisierung, d.i. als Errichtung eines autopoietischen Systems , begriffen werden kann. Zugleich manifestiert sich in ihm ein teleologisches Naturrechtsdenken in aristotelischer Tradition. Ihm liegt die Annahme zugrunde, dass das Recht kohärent sei, also Gleiches gleich und Ungleiches ungleich behandele.
