Zusammenfassung

Wilhelm, Sachenrecht ist ein jetzt in der vierten Auflage vorliegendes Standardwerk, welches das Sachenrecht im umfassenden Sinn darstellt und analysiert, nicht nur bezogen auf Sachen (bewegliche Sachen, Grundstücke), sondern auch auf die Verfügung über Rechte insgesamt, unter Einbeziehung des gesamten Kreditsicherungsrechts.

Die vierte Auflage bringt die Darstellung auf den neuesten Stand. Insbesondere berücksichtigt die Neuauflage grundlegende Änderungen durch den Gesetzgeber (gesetzliche Aufnahme der Rechtsprechung zur Rechtsfähigkeit der bürgerlichrechtlichen Gesellschaft; Neuordnung der Sicherungsgrundschuld durch das Risikobegrenzungsgesetz; Novelle zum WEG, hier Aufnahme der Rechtsprechung zur Rechtsfähigkeit der Wohnungseigentümergemeinschaft), aber auch das Erscheinen des Draft Common Frame of Reference, der die Perspektive eines sog. Politischen Common Frame of Reference entwickelt, also das ehrgeizige Modell eines dereinst weitgehend einheitlichen europäischen Rechts der Eigentumsübertragung und des Rechts der Mobiliarkreditsicherheiten verfolgt.
